I had an event in my life this past weekend and was very thankful that I did not have event to photograph. I was able to spend the needed time with my family. I realized that my agreement does not cover such events unless it is me specifically. Is there a way to cover this for the future?
If I can't cover this in my agreement, I need suggestions on what I could do for the couple or family in this event. I would not have been able to produce images or a professional demeanor had I had something to do.
Suggestons would be great.
Thanks!
Johnny

From my agreement (a modified form from Gary Fong) - I hope it helps!
Limitation of Liability John Magnoski and/or the above listed photographer may substitute another photographer to cover this event should he/she fall ill,
have a family emergency or any other unforeseen dilemma that would prevent him/her from covering the event. The above mentioned photographer warrants that any substitute photographer(s) covering the event are fully trained, competent creative professional(s) and that they be made available at No Additional Charge.

Does Gary sell forms? Or did he just help you out. I need some new forms. I know that everyone says to hire a lawyer- but where does one start with that and what are the costs involved. I am wondering if there is someone that has hired a lawyer and is selling those forms....

No, I don't believe he sells forms... but since I purchased his "Getting Rich" dvd - I found access to a pdf contract he uses and handed out during the classes. It was on his blog a while back.

Unless something happens to you on the way to the wedding, you need to make sure that they will have an alternate photographer.
Whatever is happening in your life, their wedding is just as important to them.

I missed the funeral of a close friend yesterday, and that of an aunt several years ago.
I left my dad in the ER in 1986 after having had a stroke to go shoot a wedding.
As John said, unless it is YOU, you go.
My family has instructions not to call with any kind of news until a wedding is over.
Sounds harsh, and there may come a day I regret it, but it's a decision we made when we started this business.

"any unforseen dilemma" does not seem like a phrase that has been approved by a lawyer - I doubt it's enforceable in court. Aside from that, if I were a client, I wouldn't sign such a contract. The way it's phrased it could mean that if you have a flat tire, you're not required to show up. Or if your hot water heater dies and you have to stay home and wait for the plumber. Or any other minor "unforseen dilemma".
My mom died on a Friday night at 5. I was fully prepared to shoot my wedding the next day and fly out afterwards on the red-eye. I was very very lucky to have a wonderful man call me and offer to shoot on my behalf so I could be with my family. If he hadn't offered and I hadn't been completely confident in his ability, I'd have shot the wedding myself.
BTW, that man was Denis Reggie. And he'll always be a hero to me for that.
