Full Version: Client Used My Image In Print

My local dog groomer right-clicked a proof image I took for them and used it in a local magazine without my permission, credit or payment. I have been doing 8x10's of each groomer (no more than 10) with their dog for their store wall. The arrangement was made before I realized that I'm worth more than FREE wink.gif But, these gals groom my dog every other week and I figured it'd be good local advertising.

I honestly don't think they knew it was wrong (seriously, because if I thought they did I'd be all over them about it) but now I'm faced with figuring out what to charge for something like that. Not for this one (a slap on the hand will do) but for all future images that a client would want to use for print advertising after the session took place.

So here are my questions:

1) What is the going rate to use 1 image for print advertising?

2) Do you price per image or is there a package deal?

3) Would you offer the image for commercial use for photography credit only instead of payment (seems like a fair trade since they're paying for the advertising)?

4) I should've had them sign a contract that explains the copyright, huh? wink.gif

Tough situation. I would ask for a photo credit at least. As long as you made your money upfront for the shoot then go with photo credit. If a client went behind my back and did that I would confront him or her about it so that it does not happen again

Honestly, if you already took the picture I would just let them use it and ask for a photo credit. Saying something at this point would just ruin all your hard relationship building work. At least they obviously like your work. I had a dog magazine want to use one of my images for one of their articles and I decided to just let them use it as long as I get a credit and then anything they comission me to do in the future will be charged. Hopefully you'll get tons of paying work from it.

I wonder WHAT to charge for an image for advertising next time. How much? And if they pay then do we still get photo credit or not?

I wish I knew. When I submit photos to the local paper, they pay $40 per front page image. So, I would think you should charge at least that much. Hrm. I don't have anything else to compare it to, ime. Hopefully someone else will chime in!

Maybe a friendly way to approach this is to barter a few free groomings out of it. That way, you keep the relationship with the place and they realize there is a value to your work. No money changes hands and you have a fresh start and a clean dog.
